On December 20 last year, a change to section 204F of the Electoral Act came into effect.

Members will be aware that election advertisements must include a promoter’s statement.

 

This section (in part) stated:

204F Election advertisement to include promoter statement

(1) A person may publish or cause or permit to be published an election advertisement only if the advertisement includes a promoter statement.

(2) A promoter statement referred to in subsection (1) must state the name and address of the promoter of the election advertisement.

 

An amendment to Section 204F has replaced the term “address” with the term “contact details”.

 

This means the Electoral Act is now consistent with the Local Electoral Act in this aspect of promoter statements.

 

Contact details means 1 or more of the following:

(a) a residential or business address:

(b) an email address:

(c) a post office box number:

(d) a phone number:

(e) a link to a page on an Internet site, if the page contains 1 or more of the contact details specified in paragraphs (a) to (d).

Election advertisements published or broadcast after 20 December 2025 are not required to include a residential or business address but can instead use other contact information including an email address, a PO Box number, a phone number or a link to an Internet site if contact details are available on it.
